Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and MyChessBot, LLC (“MyChessBot”, “we”, “us”, or “our”), governing your use of the website at mychessbot.comand all related features (the “Service”). By creating an account, or by otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

The Service is not directed to children under 13, and you must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

2. Your account

Accounts are created and authenticated through Clerk, our authentication provider. You are responsible for the activity that occurs under your account and for keeping your login credentials secure. You may play without an account as a guest; guest game history is tied to your browser and is described in our Privacy Policy. One person may not maintain multiple accounts to circumvent usage limits or restrictions. Notify us promptly of any unauthorized use of your account.

3. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial chess training and enjoyment. You may not resell, redistribute, or commercially exploit the Service or its content without our prior written permission.

4. Subscriptions and billing

Some features require a paid plan. Payments are processed by Stripe; we do not receive or store your full payment-card details. Paid plans are billed on a recurring basis (for example monthly or annually) and renew automatically at the then-current price until you cancel. Applicable taxes may be added. We may change plan prices or features; we will give reasonable advance notice of a price increase, and the new price applies to the next billing cycle after the notice period.

5. Cancellation and refunds

You can cancel a subscription at any time from your Account page; cancellation stops future renewals, and you keep paid access until the end of the current billing period. Except where required by law, payments and the purchase of digital goods are non-refundable, and partial billing periods are not pro-rated. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer. A specific exception applies to paid Beta Features — see “Beta and experimental features” below.

6. Virtual items and cosmetics

The Service may let you obtain virtual items such as board themes, piece sets, and other cosmetics. Virtual items are licensed to you for use within the Service, not sold; you do not own them, they have no monetary value, cannot be exchanged for cash, and are non-transferable. We may modify, retire, or discontinue virtual items, and access to them ends if your account is terminated.

7. Free features and fair use

We offer free features subject to usage limits (for example a cap on the number of game reviews in a period). These limits, and the line between free and paid features, may change over time. You agree not to abuse, automate, or attempt to circumvent these limits or any anti-abuse measures.

8. Your content

You retain ownership of the games you play and any content you submit. By using the Service, you grant us a worldwide, royalty-free license to host, store, process, analyze, and display that content as needed to operate and improve the Service (including computing bot moves, generating analysis and coaching, and producing aggregate statistics). If you choose to publish a game using a public share link, anyone with that link can view it; you can revoke a share link at any time.

10. Analysis, ratings, and coaching

Bot opponents, move analysis, estimated ratings, coaching feedback, and any AI-generated commentary are provided for training and entertainment on an “as is” basis. They are estimates and may be inaccurate or incomplete, are not guaranteed, and are not professional advice. Ratings shown on the Service are internal to the Service and do not correspond to any official chess federation rating.

11. Beta and experimental features

We may from time to time make features available on a beta, experimental, preview, or early-access basis (“Beta Features”). Beta Features are provided to give you early access and to help us evaluate them. They are offered on an “as is” and “as available” basis, may be incomplete or change, and may be modified, limited, suspended, or discontinued at any time, with or without notice, for any reason — including the loss of, or a change to, the third-party data or services they rely on. We have no obligation to continue, maintain, or generally release any Beta Feature, and we will not be liable to you for doing any of the foregoing.

Features currently offered as Beta Features include importing, reviewing, and coaching from your chess.com and Lichess games, which depend on data and access provided by those third parties, and the electronic / physical chess-board integration (connecting Square Off / MIKO boards over Bluetooth), which depends on third-party hardware and browser support. For clarity, coaching, review, and analysis of games you play on the Service itself (for example, games against our bots) are standard features and are not Beta Features.

If a Beta Feature is included in a paid plan and we modify or withdraw it, you may cancel your subscription from your Account page, and we may, at our discretion, offer a pro-rated refund for the unused portion of your then-current billing period. Beta Features are an incidental part of any paid plan and are not the primary benefit of subscribing.

12. Intellectual property

The Service, including its software, design, text, and branding, is owned by us or our licensors and is protected by intellectual-property laws. Except for your own content and the rights expressly granted here, no rights are transferred to you. The chess engine used for analysis is Stockfish, distributed under the GNU General Public License; the relevant notices and source availability are provided in the site footer.

13. Third-party services

The Service relies on third parties, including Clerk (authentication), Stripe (payments), and others described in our Privacy Policy. Beta Features may also rely on third parties such as chess.com and Lichess. Your use of those services may be subject to their own terms, and we are not responsible for third-party services.

14. Termination

You may stop using the Service at any time and may delete your account from your Account page. We may suspend or terminate your access if you breach these Terms, if required to protect the Service or other users, or if we discontinue the Service. On termination, the licenses granted to you end; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and governing law) will survive.

15. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any analysis or rating will be accurate.

16. Limitation of liability

To the maximum extent permitted by law, MyChessBot and MyChessBot, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless MyChessBot and MyChessBot, LLC from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Service, your content, or your violation of these Terms or of applicable law.

18. Changes to the Service and these Terms

We may modify or discontinue features of the Service, and we may update these Terms from time to time. Material changes will be announced on the site, and the “Last updated” date above reflects the most recent revision. By continuing to use the Service after changes take effect, you accept the updated Terms; if you do not agree, stop using the Service and may delete your account.

19. Governing law and disputes

These Terms are governed by the laws of The State of Utah, USA, without regard to its conflict-of-laws rules, and the courts located there will have exclusive jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere. Before filing a formal claim, you agree to first contact us at support@mychessbot.com so we can try to resolve the matter informally.

20. General

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
